Legitimate India is an online technology platform facilitating the creation and dissemination of educational content. Our platform hosts a vast repository of courses, operating as an open marketplace where content is published without prior legal review or editorial oversight by Legitimate India. Consequently, we do not assess the legality of the content made available on our platform. However, Legitimate India is committed to upholding intellectual property rights and requires all instructors utilizing our platform to adhere to the same standards. By submitting content to Legitimate India, instructors affirm and warrant that they possess the requisite rights, licenses, or authorizations to use and distribute such content.

Legitimate India strictly prohibits any form of intellectual property infringement on or through its platform.

This Intellectual Property Policy sets forth the procedures followed by Legitimate India in response to copyright takedown requests submitted by rights holders, as well as trademark takedown requests submitted by trademark owners concerning content hosted on our platform. Additionally, this policy outlines the measures taken by Legitimate India when courses created by its instructors are unlawfully reproduced or distributed on third-party platforms without the instructors’ authorization.

1. Copyright Takedown Notices

Legitimate India maintains a strict policy against copyright infringement. In accordance with this policy, we shall remove any content hosted on our platform upon receipt of a valid copyright infringement notice submitted by the rightful owner of the copyrighted material. Furthermore, if an instructor is determined to be a repeat infringer—defined as an individual against whom more than two valid copyright takedown notices have been received—Legitimate India reserves the right to remove all content posted by such an instructor and may, at its sole discretion, terminate the instructor’s account.

1.1 Procedure for Filing a Copyright Takedown Notice

If you are the copyright owner or an authorized representative of the copyright owner and wish to report allegedly infringing content available on the Legitimate India platform, you may submit a copyright takedown notice. The most efficient method is by filling out the copyright complaint form (available in English only). Alternatively, such notices may be submitted to Legitimate India’s designated copyright agent, whose details are provided below.

1.2 Important Considerations Before Filing a Copyright Takedown Notice

1.2.1 Only the Copyright Owner or Authorized Agent May File a Claim

Legitimate India cannot process claims of copyright infringement unless they are submitted by the actual copyright owner or their duly authorized agent. We are not in a position to ascertain whether an instructor has obtained the necessary permissions from the copyright owner to use the content in question. The complainant will be required to provide an electronic signature confirming that they are either the copyright owner or have the legal authority to act on behalf of the copyright owner (including where the copyright owner is an organization).

1.2.2 False or Misleading Claims May Attract Legal Consequences

Knowingly submitting a false, frivolous, or misleading copyright takedown notice is unlawful and may expose the complainant to civil liability, including payment of damages. Legitimate India reserves the right to initiate legal proceedings and seek damages against any party that submits an illegitimate claim of copyright infringement.

1.2.3 Fair Use Considerations

Before filing a copyright claim, the complainant should evaluate whether the alleged infringing content qualifies as “fair use” under copyright law. The doctrine of fair use allows for certain uses of copyrighted material in the public interest, such as for purposes of criticism, commentary, news reporting, and research.

In assessing whether fair use applies, the complainant should consider:

  • Purpose of use (whether the content is commercial or non-commercial, and whether it critiques, parodies, or transforms the original work).
  • Nature of the copyrighted work (whether the original work is factual or creative).
  • Extent of use (whether only a small, necessary portion is used or a substantial part of the work is copied).
  • Market impact (whether the use of the material affects the commercial value or potential sales of the original work).

1.2.4 Certain Types of Content Are Not Protected by Copyright

Copyright law does not extend protection to short phrases, business names, book titles, slogans, ideas, processes, methods, or factual information. If the complaint pertains to a trademark violation, the complainant must follow the procedure set out in the section on Trademark Takedown Notices.

1.2.5 Required Information for a Copyright Takedown Notice

To ensure that the copyright claim is valid and can be processed, the complainant must provide the following details:

  • Full legal name, email address, physical address, and an optional telephone number.
  • If filing on behalf of an organization, the name of the organization and the complainant’s designation.
  • A precise identification of the original copyrighted material, or in cases where multiple copyrighted works are involved, a representative list of such works (for example, URLs linking to the original content).
  • Sufficient details to locate the allegedly infringing content on the Legitimate India platform, including the URL of the infringing content, the exact name of the course, and the instructor’s name.
  • A statement declaring: “I declare, under penalty of perjury, that the information in this complaint is accurate and that I am the copyright owner or am authorized to act on behalf of the copyright owner. I further state that I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”

1.3 Counter-Notification

If a copyright takedown notice is deemed valid, Legitimate India shall:

  1. Remove the content in question from the platform.
  2. Notify the instructor responsible for posting the content that:
    • Their content has been reported for copyright infringement.
    • The reported content has been removed.
    • They may submit a counter-notification if they believe the removal was a mistake.

1.4 Procedure for Filing a Counter-Notification

If an instructor believes that the copyright takedown notice was incorrect or that they had proper authorization to use the reported content, they may submit a counter-notification to Legitimate India.

1.5 Important Considerations Before Filing a Counter-Notification

  1. False or Misleading Counter-Notifications May Attract Legal Consequences
    Knowingly submitting a false or misleading counter-notification is unlawful and may expose the instructor to legal liability, including damages. Legitimate India reserves the right to initiate legal proceedings against any party submitting an improper counter-notification.
  2. Required Information for a Counter-Notification
    To be valid and legally effective, a counter-notification must:
    • Contain the instructor’s physical or electronic signature.
    • Include the instructor’s full name, address, email ID, or telephone number.
    • Identify the content that was removed along with the original location (URL) where it was posted prior to removal.
    • Include a statement under penalty of perjury affirming that the instructor has a good faith belief that the material was removed due to a mistake or misidentification.
    • Include a consent statement, whereby the instructor agrees to:
      • Legitimate India sharing their name and contact details with the complainant.
      • Accepting service of legal process from the complainant.
      • Submitting to the jurisdiction of Indian courts in case of any legal proceedings.
  3. Submission of Counter-Notification
    The best method to submit a counter-notification is by filling out the form provided by Legitimate India and submitting it to the designated copyright agent or copyright compliance team.

2. Trademark Takedown Notices

This document sets forth the policy of Legitimate India with respect to the removal of content that has been reported and subsequently determined to infringe upon a third-party trademark. For the purposes hereof, if you are a trademark owner or an authorized representative thereof, you may duly submit trademark takedown notices to Legitimate India. It is hereby noted that Legitimate India reserves the right to terminate the account of any instructor at its sole discretion, including, without limitation, in instances where such instructor has disseminated content that violates the trademark rights of any third party within its marketplace.

2.1 Procedure for Submitting a Trademark Takedown Notice

The most expeditious method to effectuate a trademark takedown notice is by utilizing the designated trademark complaint form. Please be advised that upon submission, a copy of the notice shall be transmitted to the uploader of the content being reported.

2.2 Prior to submission of a trademark takedown notice, the following stipulations must be meticulously observed:

2.2.1 Substantiation of Trademark Claim

The claimant’s assertion must be sufficiently substantiated to permit Legitimate India to effectuate appropriate remedial measures. In this regard, the communication shall, at a minimum, incorporate the following details:

  • The complete contact information of the claimant, including full name, mailing address, and either an email address or telephone number;
  • The specific word, symbol, or other identifying mark for which trademark rights are claimed;
  • The basis upon which the claim to trademark rights is made, including details of national or community registration and, if applicable, the registration number;
  • The jurisdiction or country in which the trademark rights are claimed;
  • The classification of goods and/or services for which the trademark rights are asserted;
  • The precise location(s) within the reported course URL(s) where the registered trademark is visible;
  • A detailed description of the manner in which the content is alleged to infringe upon the trademark;
  • In the event the claimant is not the rights holder, an explication of the relationship with the rights holder;
  • The following declarations, which must be incorporated verbatim:
    • “I have a good faith belief that use of the trademark as described above in the manner complained of is not authorized by the trademark owner, its agent, or the law.”
    • “The information in this notice is accurate, and I declare, under penalty of perjury, that I am the owner or authorized to act on behalf of the owner of a trademark that is allegedly infringed.”
    • “I agree that Legitimate India may forward my complaint, including my contact information, to the affected user.”
  • The claimant’s electronic signature, denoted by “/s/” followed by the claimant’s full name (e.g., “/s/ Jane Doe”), or an equivalent physical signature.

2.2.2 False or Misleading Claims

The submission of any false or misleading claim of infringement may render the claimant liable for any resultant damages. Legitimate India expressly reserves the right to seek redress for any damages arising from the submission of a false or misleading notification of claimed trademark infringement.

2.2.3 Consideration of Fair Use

The claimant is hereby advised to carefully consider whether the use of the trademark within the content may qualify as “fair use”. Trademark law, while designed to prevent consumer confusion through the protection of a name or brand, recognises certain exceptions under which the use of a trademark is permissible. Such exceptions generally permit the use of a trademark for purposes of factual reference or commentary, including criticism of the trademark. The claimant must duly assess the likelihood that consumers might erroneously infer that the content in question is sponsored by or originated from the claimant’s company or brand.

3. Infringement of Legitimate India Content on Third-Party Platforms

It is further understood that upon the posting of content on the Legitimate India platform, the originator of such content may reasonably expect that said content shall not be made available on any other platform without the requisite permission. In order to mitigate instances of copyright infringement and piracy affecting courses offered by our instructors, Legitimate India has engaged the services of an anti-piracy vendor. This vendor shall monitor for instances of infringement and endeavor to have such content removed from major search engines, thereby curtailing subsequent traffic.

In the event that you discover your course content being hosted on another platform without your authorization, you are hereby directed to complete the third-party piracy reporting form, so that appropriate action may be initiated.
