Here in this topic, we are going to discuss about the independence of judiciary. The judiciary is an independent system which is its core nature for functioning democracy. It is essential because the judiciary makes laws and orders without any Political pressure, and they also give justice equally to everyone. Now here we are going to discuss some of its importance and key points through which one can easily achieve it. Let us begin with the importance of an independent judiciary.

Importance of Independence of Judiciary

  • First and foremost importance is that the judiciary provides equality among every citizen by giving equal justice. It doesn’t do partiality between rich and poor, officers and clerks, etc.
  • It also upholds law and order, by their conduct no one can misuse power. And it also prevents arbitrary decision-making.
  • It also acts as a check of both organs of government the legislature and executive. It always keeps its eyes on the lawmaking process where it ensures that no one is violating the legally protected rights of citizens.

So, here we have learned some of the importance of an independent judiciary. Now, let us see how one can achieve an independent judiciary in their country. 

How to Achieve the Independence of Judiciary?

  • Judges have security of tenure, they are retired after their tenure. They are appointed by the president of India.
  • The judiciary has its other budget, which shows that it is not beholden to other organs of government.
  • The judges under the judiciary system, can only be removed by the authority if they do misconduct, and do not fairly do their duties and responsibilities.

Which gave guarantee to all the citizens to give them fair play of the legal system and prevent or resolve every issue without doing partiality. It also provides equal laws and rights to entire citizens of the state.
